Information on H-3 Visa

Employers in the United States have established a training program consisting of classroom training over a training job. Employer in the United States must also demonstrate that the knowledge and experience that international students are not available by country of origin of the foreigner. Foreign workers must receive training and be able to demonstrate that education should be used if the alien returns to the foreign company or an organization that is related to or affiliated with the operations of the employer in the United States. Here are some tips below:

Foreign employee may be involved in any productive employment during training. Any employment or work abroad can only be secondary and a necessary part of training.

Foreign students must demonstrate that, after the temporary period of training, the foreign worker will go home and use of training in the country of origin.

The U.S. employer must file a petition to request authorization for the INS an alien to enter the United States and enter the program of training. If INS approves the application request, the U.S. employer receives a notice of approval.

The trainee may receive a H-3 visa for no longer than a two year period. If the U.S. employer initially requested the alien to enter the U.S. only for a one year training period, the foreigners may be permitted to stay for a second year, if requested by the U.S. employer. Please note that no extensions are permitted beyond the two year limitation of stay. If the trainee is in the U.S., the trainee will need to also apply for an extension at the same time as the U.S. employer is applying for an extension with the INS. The alien should receive back from the INS the original 1-94 card with approval of the extension of stay under H-3 status.
